Proposition de résolution portant constitution d'une commission d'enquête parlementaire au sujet de la non-indemnisation des soixante onze (71) victimes du boeing 737-200(Le Nyong) qui s'est écrase le 03 décembre 1995 à Douala.
A,
Monsieur le Président de l'Assemblée Nationale, Yaoundé,
L'Honorable Joseph Mbah-Ndam et les Membres du Groupe Parlementaire du Social Democratic Front (SDF), à l'Assemblée nationale ;

Ont l'honneur de vous exposer.
Attendu que par une lettre ouverte du Ministre d'État, Marafa Hamidou Yaya écrite à partir de la prison où il se trouve actuellement, adressée au Président de la République et publiée dans plusieurs journaux de la place, il ressort que les soixante onze (71) victimes du crash du Boeing 737-200 de la défunte CAMAIR le 03 décembre 1995 n'ont jamais été indemnisées malgré le fait que la procédure judiciaire contre la société TRANSNET-SOUTH AFRICAN AIRWAYS avait abouti au paiement de la somme colossale de 32.500.000.000F Cfa:


En effet, il ressort de cette lettre qu'en mai 1994 des accords écrits avaient été conclus à Paris, France, par lesquels la TRANSNET-SOUTH AFRICAN AIRWAYS s'engageait à assurer la maintenance des Boeing 737 et 747 appartenant à la défunte CAMAIR ;
Que c'est du fait de la corruption de quelques autorités Camerounaises et employés de la défunte CAMAIR par la société Sud-Africaine citée ci-haut, qui avait résulté en une défaillance et la grossière négligence dans l'exécution desdits contrats, entraînant par la suite le crash du Boeing 737-200 baptisé Le Nyong en 1995 et occasionnant la perte en vie humaine, et la perte d'un réacteur en plein vol, par le Boeing 747-200, aux environs de Paris, en France ;
Que cette corruption mise à nu par le Comité de Suivi de l'Exécution desdits contrats de maintenance crée par la suite par Arrêté N° 530/CAB/CAB/PR en date du 14 novembre 2000 rendait nul et nul effet lesdits contrats et en conséquence la restitution de la somme de 32.500.000.000F.cfa indûment perçue sans compter le montant des dommages et intérêts ;
Que le Comité de Suivi de l'Exécution desdits contrats de maintenance avait pour mission, entre autres, d'ester en justice et défendre les intérêts tant de la CAMAIR que de l'Etat du Cameroun ;
Qu'après plusieurs années, il (Marafa Hamidou yaya) a été informé que l'affaire fut jugée, que TRANSNET -SAA fut condamnée et que le Cameroun fut indemnisé.

Qu'il avait, à l'époque proposé au Président de la République, l'indemnisation des soixante-onze victimes en raison de 100.000.000F.cfa par victime, soit au total 7.100.000.000F.Cfa et dont le reste d'un montant de 25.500.000.000FCf.cfa plus les dommages-intérêts devaient être reversés à la CAMAIR ;
Que jusqu'aujourd'hui ni les victimes n'ont été indemnisées ni la somme de 25.500.000. 000FCfa plus les dommages-intérêts reversée à la défunte CAMAIR dont ses ex-employés n'ont jamais été payé leurs droits ;
Qu'il convient de rappeler ici que le versement de ces milliards à la CAMAIR l'aurait sauvé de la faillite ;
Que curieusement et à sa grande consternation, les bénéficiaires de la corruption qui est la cause fondamentale de ces tristes événements, quelques années plus tard se sont vus promus et certains à des fonctions gouvernementales.

C'est pour quoi ils sollicitent très respectueusement, Monsieur le Président ;
Vu la constitution, loi fondamentale de la République du Cameroun, qui prévoit dans ses articles 14(2), 29 et 35 le contrôle de l'action gouvernementale par, inter allia, la constitution des commissions d'enquêtes parlementaires sur des objets déterminés ;
Vu le règlement de l'Assemblée (amendé par loi N° 93/001 du 16 juin 1993) en son article 67, ensemble la loi N° 91/029 du 16 décembre 1991 qui spécifie la procédure en la matière ;
Demandons par conséquent la constitution d'une enquête parlementaire pour vérifier ces informations et établir les Responsabilités aux fins de :
1.Indemniser les familles des soixante-onze victimes du crash du Boeing 737-200 de la défunte CAMAIR le 03 décembre 1995 ;
2. Reverser au liquidateur de la défunte CAMAIR la somme de 25.500.000.000F.Cfa plus les dommages-intérêts pour faire face au paiement des droits des ex-employés qui n'ont jamais été payés ;
3. Traduire en justice les auteurs et complices des ces actes qui ont résulté en perte de vie humaine, destruction du patrimoine public et détournement de la fortune publique.

DRAFT RESOLUTION FOR THE CRATION OF A PARLIAMENTARY COMMISSION OF ENQUIRY IN RESPECT OF THE NON INDEMNISATION OF THE SEVENTYONE (71) VICTIMES OF THE BOEING 737-200 (THE NYONG) THAT CRASHED IN DOUALA ON 03 DECEMBER 2012.
To,
The President of the National Assembly, Yaounde,
Honourable Joseph Mbah-Ndam and Members of The Social Democratic Front Parliamentary Group (SDF), at the National Assembly;

HAVE THE HONOUR TO STATE AS FOLLOWS.
That in an open letter written by Minister of State, Marafa Hamidou Yaya presently in prison custody, addressed to the President of the Republic and published in numerous newspapers, it emerges from the said letter that the seventy one (71) victims of the Boeing 737-200 belonging to the defunct CAMAIR which crashed on 03 December 1995 have never been indemnified despite the fact that the legal proceedings against TRANSNET-SOUTH AFRICAN AIRWAYS resulted in the payment of a colossal sum of Thirty Two Millard, Five Hundred Thousand (32.500.000.000) F.cfa:
Indeed, it emerges from the said letter that in May 1994 written agreements had been entered into in Paris, France by which TRANSNET-SOUTH AFRICAN AIRWAYS undertook to ensure the maintenance of Boeing 737 and 747 belonging to the defunct CAMAIR ;
That it is because of the corruption of certain Cameroonian authorities and workers of the defunct CAMAIR the South African Company cited above, which resulted in failure and gross negligence in the execution of the said contracts, leading in consequence to the crash of the Boeing 737-200 baptised as "Le Nyong" in 1995 and occasioning the loss of human lives, the loss of the reactor of Boeing 747-200, in the course of a flight in Paris, France;
That this corruption was exposed by the Follow-up Committee of the execution of the said contracts of maintenance created in consequence by Arrêté (Order) N° 530/CAB/CAB/PR of 14 November 2000 rendering null and void the said contracts and the restitution of the sum of Thirty Two Millard, Five Hundred Thousand (32.500.000.000) F.cfa unjustly paid to the said South African Company without not taking into account damages that were equally paid;
That the Follow-up Committee of the execution of the said contracts of maintenance had also as mission, inter alia, to commence legal proceedings against TRANSNET -SAA for and on behalf of CAMAIR and the state of Cameroon;
That after several years, he, (Marafa Hamidou yaya) has been informed that the matter was heard and determined and TRANSNET -SAA found guilty and the state of Cameroon indemnified;
That he had at that time, proposed to the Presi.000F.cfa per victim, making a total of 7.100.000.000FCfa and the rest of 25.500.000.000F.cfa plus the damages paid to the defunct CAMAIR ;
That up to date neither the victims have been indemnified nor the sum of 25.500.000.000. FCfa plus the amount of the damages paid to the liquidators of the defunct CAMAIR whose ex- employees have never been paid their rights;
It is worth while emphasising here that had these milliards been paid to CAMAIR it would not have gone into liquidation;
That curiously and to his great surprise the beneficiaries of this corruption that was the fundamental cause of these sad events, some years later, have been promoted and some to governmental functions ;

It is for these Reasons That They Solicit, Most Respectfully, Mr President of the National Assembly;
Mindful of the constitution, the Fundamental Law of the de la Republic of Cameroon, which provide in sections 14(2), 29 and 35 the oversight of government action through, inter alia, the establishment of Parliamentary Commissions of Enquiry For specified subjects;
Mindful of the provisions of section 67 of the Standing Orders of the National Assembly as amended by laws N° 93/001 of 16 June 1993 and 2002/005 of 02 December 2002) read in conjunction with law N° 91/029 of 16 December 1991 which specifies the procedure in this regard ;
Hereby request in consequence, the establishment of a Parliamentary Commissions of Enquiry to investigate the said allegations and apportion responsibilities with view to :
1.Indemnify the families of the seventy-one victims Boeing 737-200 crash 03 December 1995
2. Pay back to the liquidator the defunct CAMAIR the sum of 25.500.000.000F.cfa plus the damages that were recovered to enable him pay the rights of the ex-employees who up to date have not been paid ;
3. Bring to book before the competent jurisdictions authors and assessories of these heinous acts that resulted in the loss of human lives, the destruction of public wealth and the embezzlement of public Funds.
